The Fair Labor Standards Act enacted the final ruling on overtime pay. The changes are as follows:
- Salaried employees that earn a salary level less than $47,476 per year (or less than $913 per week) AND are working more than 40 hours per week must be paid overtime. In order to meet the new ruling, you must either increase their salary level to become exempt from overtime pay or change them to hourly pay.
- Reminder: In order for a salaried employee to be exempt from overtime pay, they must meet the jobs test.
Please note, it is the employer’s responsibility to verify the amount of hours the employee works.
